The instant application is filed seeking restoration of the aforementioned first appeal, so also the condonation of delay of 114 days in preferring this application. Having considered the contents of the application, so also considering the submissions made by Mr.Hakim, learned advocate for the applicants, and considering the order dated 14.2.2012, it appears that the aforementioned appeal came to be dismissed for want of removal of office objection. Mr.Hakim, learned advocate for the applicants assures that the office objection shall be removed within one week and appropriate Court fees shall be paid.
In above view of the matter, the instant application is allowed in terms of paragraphs 5(A) and 5(B) of this application and the aforementioned first appeal is ordered to be restored on the condition that the office objection shall be removed by the applicant within one week hereof.
The application stands disposed of accordingly.
