Present application under Section 5 of the Limitation Act has been preferred by the applicants herein-heirs and legal representatives of original appellant to condone the delay in preferring Civil Application for brining the heirs and legal representative on record as well as to set aside the abatement.
Having heard learned advocate for the respective parties and in the facts and circumstances of the case narrated in the present application, delay caused in preferring application for bringing the heirs and legal representatives of the original appellant and setting aside the abatement is hereby condoned. Rule is made absolute to the aforesaid extent.
