Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the learned District and Sessions, Nagappattinam, to conduct trial in S.C.No.55 of 2015 as expeditiously as possible on a day to day basis and complete the same within a stipulated time frame.

It is the case of the petitioner that on 14.8.2003, her husband was murdered and on his death, a case was registered in Crime No.181 of 2003 and after investigation, charge sheet was filed before the learned Judicial Magistrate at Vedaranyam and the same was taken on file as P.R.C.No.16 of 2008. After committal, now, the case is pending before the learned District and Sessions Judge, Nagappattinam, in S.C.No.55 of 2015. Though the occurrence had taken place in the year 2003, till date, the trial has not commnced. Hence, seeking early disposal of the said case, the petitioner has come up with the present petition.
3. Today, when the matter was taken up for consideration, on instructions, learned Additional Public Prosecutor submitted that the 8th accused in this case is absconding and hence, the trial has not yet commenced.
4. Considering the facts and circumstances of the case, this Court directs the respondent police to secure the 8th accused in S.C.No.55 of 2015 forthwith and produce him before the learned District and Sessions Judge, Nagappattinam, and the learned District and Sessions Judge, Nagappattinam is directed to dispose of S.C.No.55 of 2015, as expeditiously as possible, preferably, within a period of three months thereafter. The criminal original petition is disposed of accordingly.

This petition is listed today under the caption 'For Extension of Time".
2. Earlier this court vide order dated 13.02.2017 in the above Criminal Original Petition had directed the District and Sessions Judge, Nagapattinam, to dispose of the S.C.No.55 of 2015 within a period of three months from the date of receipt of a copy of the order. However, learned Magistrate had expressed certain difficulties in disposing of the case within the time stipulated by this Court and had sought for further time.
3. In view of the same, the learned District and Sessions Judge, Nagapattinam, is granted further three months time from the date of receipt of a copy of this order to dispose of S.C.No.55 of 2015.
