Though it is a case of entitlement to family pension the dispute which arises in the present petition is whether the petitioner is widowed wife of late Vasantbhai Mohanlal Parmar, who was working with the respondent authority, or the nominated person - Sarlaben Vasantbhai Parmar.
Considering the affidavit-in-reply filed by respondent No.3, Mr.K.B.Pujara, learned advocate for the petitioner, seeks permission to withdraw the petition, as the matter involves disputed questions of facts which cannot be decided in the present petition under Article 226 of the Constitution of India, with a liberty to raise the same issue before a competent forum.
With this observation, the petition is permitted to be withdrawn. NOTICE discharged. No costs.
