Mr.D.K.Puj, learned advocate for the petitioners submits that the case of the petitioners is covered by the judgment of this Court rendered in the case of Kishanbhai Hargovandas Patel, and another V. State of Gujarat and others, reported in 2010(4)GLR 2867 by which the Court has held that an opportunity of hearing is required to be given to the parties affected by the proposed modification where the State Government proposes to sanction the Preliminary Town Planing Scheme with modifications.

Mr.Ronak Rawal, learned Assistant Government Pleader pays for time in order to go through the said judgment.
