THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 8830 of 2008 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed for the following relief:
“… Hon’ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in not conducting the auction of the leasehold rights for the land of Ac.28.08 cents covered by Sy.No.63 of Thumadu Revenue village belonged to the 5th respondent’s temple inspite of expiry of earlier term of lease and representation dated 11.04.2008 submitted by the petitioner, as illegal, irregular, arbitrary, violative of the provisions of Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987, the Rules framed thereunder and offends Articles 14, 25 and 26 of Constitution of India and consequently direct the respondents to conduct auction of leasehold rights and grant lease pursuant thereto for the current agricultural year onwards.”
Learned counsel for the 4th respondent submits that auction has already been conducted during the pendency of the writ petition.
We therefore look at the prayer made in the writ petition and feels that nothing is to be done by this Court. We are also surprised to see why this sort of litigation has been filed at all.
The writ petition is accordingly closed. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
