Heard learned counsel for the applicant, Sri Pankaj Bharti, learned counsel for the complainant and learned A. G. A. for the State.
The present anticipatory bail application has been filed by the applicant in Case Crime No. 537 of 2019, under Sections 323, 354, 354B IPC, Police Station Loni, District Ghaziabad with the prayer to grant anticipatory bail to the applicant.
I have perused the FIR as well as the order by means of which the anticipatory bail application has been rejected by the court below.
Perusal of the record shows that the present applicant himself has filed a criminal writ petition before this Court being no. 17092 of 2019 challenging the FIR registered as case crime no. 537 of 2019, under Sections 323, 354, 354B IPC, Police Station Loni, District Ghaziabad and the said writ petition was disposed of with a direction to the applicant to appear before the court concerned within 45 days and apply for bail and in case the applicant does not appear before the court concerned within the aforesaid time, coercive action shall be taken against the applicant.
After hearing the learned counsel for the applicant and also looking to the fact that the applicant has already approached this Court by means of filing a writ petition, no case for grant of any indulgence is made out.
Accordingly, the application for anticipatory bail is rejected.
