By means of the present petition, the petitioner is seeking a writ of mandamus commanding the respondent no. 2 namely the licensing authority to decide the pending application no. 48 of 2015 dated 27.6.2015 moved by the petitioner for transfer of fire arms licence, which was initially in the name of his father, who had died in the year 2013.
It is noteworthy that during the pendency of the said application, the rules namely Arms Rules, 2016 has come into operation.
In view thereof, it would be appropriate that the petitioner shall move a fresh application under the prescribed proforma under the Arms Rules, 2016 within a period of three months from the date of receipt of certified copy of this order. In case, such an application is moved, the licensing authority would be under obligation to complete all formalities and to decide the said application, as expeditiously as possible, preferably within a period of three months thereafter under due notice to the petitioner.
