Challenge is made to the order passed by Family Court on 13.3.2012 in Family Suit No. 958 of 2006 vide order below Exh. 10.
Learned advocate Mr.R.L.Mehta appearing for petitioner-wife and children urged that on 23rd January, 2012 in Special Civil Application No. 4903 of 2011 (Coram : Mr.C.L.Soni, J) specific direction has been issued and though there has been no order passed under Section 125 of Code of Criminal Procedure in the interregnum period, Family Court has disregarded the direction of this Court and therefore, order impugned requires quashment. He has also urged that the husband has not complied with the order issued by this Court of paying the maintenance granted to the wife and children.
Issue notice to the other side returnable on 12th June, 2012.
