Learned APP Mr. Kodekar waives service of notice of rule on behalf of opponent - State.
2. The applicant has prayed for relaxation of condition imposed by this Court with regard to not to leave the territory of State of Gujarat in Criminal Miscellaneous Application No.11977 of 2008 in Criminal Appeal No.2094 of 2008 dated 14.10.2008, and to permit him to visit his relatives, as and when required.
3. Having regard to the averments made in the application and oral submissions, the condition imposed by this Court with regard to not to leave the territory of State of Gujarat vide order dated 14.10.2008 is hereby relaxed for the period between 14.05.2012 and 08.07.2012 and the applicant is permitted to leave the territory of State of Gujarat for such period.
4. As regards relief made in prayer paragraph 6(B), learned counsel for the applicant does not press.
5. Rule is made absolute to the aforesaid extent. Direct service is permitted today.
