The petitioner's vehicle bearing registration No.KL-10- N-1332 has been seized alleging transportation of river sand without valid permit. The petitioner seeks to release of the vehicle. The petitioner has an alternate remedy before the competent jurisdictional magistrate under Section 23A of the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001. Therefore, the petitioner has to move the competent jurisdictional magistrate for interim custody of the vehicle. If the petitioner moves such an application for interim custody of the vehicle, the competent jurisdictional magistrate shall consider the same within ten days from moving such application. There shall also be a direction to the third respondent to report seizure of the vehicle before the competent jurisdictional magistrate within three days from

2 the date of receipt of a copy of this judgment. The Revenue Divisional Officer is also directed to finalise the proceedings for confiscation of the vehicle after hearing the petitioner, within one month.
