. Respondent Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House Officer Badvel (U) P.S., Y.S.R.Kadapa District to release the petitioner on bail in the event of his arrest in connection with the Crime No. 57/2014 of Badvel (U) P.S., Y.S.R.Kadapa District.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments o f Smt. P. Rajani Reddy, Advocate for the Petitioners and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“Petitioners are A1 and A2. They seek for grant of anticipatory bail. They allegedly committed offences, which are triable by a Magistrate of First Class. It would be appropriate for the petitioners to surrender before the trial Court and move the trial Court for grant of regular bail as the offences are triable by a Magistrate of First Class.
However, the first petitioner is a senior citizen. In view of the age of the first petitioner, I consider it appropriate to enlarge the first petitioner on anticipatory bail.
Consequently, this Criminal Petition is allowed so far as the first petitioner is concerned. The first petitioner shall surrender before the learned Judicial Magistrate of First Class, Bedvel, within two weeks from today. On such surrender, the learned Judicial Magistrate of First Class, Bedvel, shall enlarge the first petitioner on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to his satisfaction.
So far as the second petitioner is concerned, this Criminal Petition is disposed of giving liberty to the second petitioner to surrender before the trial Court and move the trial Court for grant of regular bail. In such an event, the Trial Court shall consider such an application on merits, without being influenced by any part of this order, and shall dispose of the same on the same day on which it is filed.”
