JUDGMENT / ORDER

When the application came up for hearing today, learned counsel for petitioner, on the basis of the statement filed by the State Attorney, in which it is stated that considering the relationship between the parties when a preliminary inquiry was conducted, it was revealed that no such incident happened, no crime was registered, which according to the petitioner is not true, he may be permitted to withdraw this petition with liberty to pursue his remedy provided under the Code of Criminal Procedure by filing a private complaint before the appropriate forum.
