THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.1567 of 2014 ORDER :
This writ petition, under Article 226 of the Constitution of India, is filed seeking the following reliefs:
(1) Declaring the action of the first respondent herein in issuing letter in Rc.No.N1/27520/2009, dated 19.04.2010, basing on which the proceedings issued by the 2nd respondent dated 30.11.2013 stating that the land situated in T.S.Nos.23, 24, 27/1 and 28/2 of Tirupati Village, Tirupati Mandal, Chittoor District is prohibited for registration, as arbitrary, illegal and unconstitutional,
(2) Consequently direct the 2nd respondent herein to entertain and process the documents to be submitted by the members of the petitioner Society in respect of the subject land.
2. Heard Sri T. Nagarjuna Reddy, learned counsel for the petitioner and the learned Government Pleader for Revenue for the respondents.
3. When the matter is taken up for consideration, the learned counsel for the petitioner as well as the learned Government Pleader represented that on the subject matter, judgment is rendered by this Court in Pasuparthi Jayaram Vs. Government of Andhra Pradesh

This Court set aside the communication, dated 19.04.2010, of the Commissioner, Endowments Department, Hyderabad (1st respondent) and issued consequential directions to the Sub-Registrar, Tirupati Urban, Tirupati, Chittoor District (2nd respondent), to receive and process the document presented by the petitioner in respect of its land.

For the reasons alike, this Writ Petition is allowed setting aside the impugned letter in Rc.No.N1/27520/2009, dated 19.04.2010, issued by the first respondent herein and directing the 2nd respondent to receive and process the document presented by the petitioner in respect of the land situated in T.S.Nos.23, 24, 27/1 and 28/2 of Tirupati Village, Tirupati Mandal, Chittoor District, without reference to the said letter, dated 19.04.2010. It is made clear that in the event the document presented is found to fulfil the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the 2nd respondent shall complete the registration formalities and release the document in accordance with the due procedure. There shall be no order as to costs. Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
