1. Ms.Shailee Shah, learned Advocate for Mrs. Pahwa, learned Advocate for the petitioner has tendered on record a letter dated 28th December 2011 and its annexure i.e. resolution of the Board of Directors which is said to have been passed in the meeting held on 26th December 2011. On the strength of the said letter dated 28th December 2011 and the said resolution she submitted that she has been asked by the client to withdraw the captioned petition since the petitioners have decided not to proceed with the proposed merger. She has, therefore, requested for permission to withdraw the petition.
The request as prayed for is granted. The petitioners are permitted to withdraw the petition. The order dated 21.11.2011 and the previous order dated 21.10.2011, therefore, stand cancelled.
With the aforesaid clarification and direction the petition is disposed of as withdrawn.
The aforesaid communication dated 28th December 2011 and the resolution are retained on the file.
