Sri Vishwa Deepak Mishra, learned counsel holding brief of Sri Rohit Nandan Pandey, learned counsel for the petitioner submits that the petitioner undertakes to make an application for copy of her answersheet, in the subject of Mathematics in the 3rd Semester of D.El.Ed. Training Course-2017 in the prescribed proforma alongwith the deposit of requisite fee.
The only prayer made by learned counsel for the petitioner is that the aforesaid application may be decided within a stipulated period of time.
Learned Standing Counsel submits that in case, the petitioner submits an application in the prescribed format, after deposit of requisite fee, and the answersheet has not been weeded out as per law, the respondent Board is under obligation of law to decide the representation of the petitioner.
In light of the submissions made by learned counsel for the parties, the matter is remitted to the respondent no. 2, Examination Regulatory Authority, U.P., Prayagraj.
The writ petition is finally disposed of with the following directions:
1. The petitioner shall submit the representation within a period of 10 days in the prescribed format along with the deposit of requisite fee before the respondent no. 2.
2. The respondent no. 2 shall decide the representation of the petitioner for a copy of her answersheet in the 3rd Semester of D.El.Ed. Training Course-2017, within a period of three weeks from the date of receipt of a certified copy of this order.
In case there is some infirmity/deficiency in the application, the petitioner shall be noticed on the same and shall be given an opportunity to cure the deficiencies.
This order shall not apply in case the the answer-sheet has been weeded out.
