Petitioner has approached this Court seeking a mandamus commanding the respondent No.1- District Magistrate-Varanasi to issue appropriate direction to respondent No.2-Sub-Divisional Magistrate Tehsil Raja Talab, District-Varanasi and respondent No.3-Lekhpal, Tehsil Raja Talab, District-Varanasi for taking steps to provide the police force for dispossession of unauthorized occupation of respondents No.4, 5 and 6 from disputed land measuring area 0.12 Air of plot no.280 in village Pure Bariyar Tehsil Raja Talab, District-Varanasi and deliver the possession back to the petitioner.
From the pleadings, it appears that there is some dispute in respect of the plot in question between the petitioner and respondents No.4, 5 and 6.
It is well settled that the police authorities have no jurisdiction to interfere into the civil dispute pertaining to the property and thus, the matter is liable to be dismissed. We, however, leave it open to the petitioner to avail such other remedy, which may be available to him in law, if so advised.
With the aforesaid observation, the writ petition is dismissed.
