JUDGMENT / ORDER

The stranger alienee has been tentatively allotted 1.85 cents of land adjacent to the dwelling house. Neither Section 22 of the Hindu Succession Act, 1956 nor Section 4 of the Partition Act, 1893 enable other sharers from purchasing the right of the stranger if he is not willing. The stranger is not a transferee of share in the dwelling house in order to enable the other sharers to purchase his share. The court below was perfectly justified in turning down the request of the petitioners for purchasing the share of the stranger.
The Original Petition is dismissed.
