In compliance of Court's order, Director, Animal Husbandry Department, is present in person before this Court.
Sri Lalit Shukla, Addl. Chief standing Counsel says that the orders, which have been sought to be complied with, were passed on the first date of filing of the petition and without hearing the opposite parties. He further says that the petitioner is not a regular employee, as such pension is not payable to her. An stay vacation application filed along with the counter- affidavit, is pending before the Court.
Sri Pratyush Tripathi, learned counsel for the petitioner has refused this averment. He has drawn the attention of this Court towards the order passed in Writ Petition No. 1760 (S/S) of 1987. He further says that in this matter, the writ court vide order dated 08.11.2005, had declared that the petitioners were appointed on a regular vacancy after adopting regular procedure. The writ court has passed order after going through this order.
However, let counter- affidavit be filed by the opposite parties within two weeks. Rejoinder-affidavit, if any, may be filed within a week thereafter.
