This Writ Petition is filed under Article 226 of the Constitution of India, praying to direct respondents to consider the written complaint given to the respondents on 3.5.2016 by the petitioner about the commission of cognizable offence by registering the first information report and investigate the matter at Annex-D and etc.
This Writ Petition coming on for preliminary hearing in ‘B’ group this day, the Court made the following:-
ORDER None for the petitioner.
Sri.Vijay Kumar A.Patil, learned Additional Government Advocate for the respondent.
2. In this petition, the petitioner has prayed for the following reliefs:
“A) Issue writ of mandamus or in the nature of writ by directing the respondent to consider the written complaint given to the respondents on 03.5.2016 by the petitioner about the commission of cognizable offence by registering the first information report and investigate the matter, in the interest of justice and equity (Annexure D) B) Pass such other order or order’s as this Hon’ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity.”
3. When the matter was taken up today, learned Additional Government Advocate submitted that acting on the complaint submitted by the petitioner, an endorsement has been issued to the petitioner, by which she has been informed that no action has been taken as the dispute involved is a civil dispute. The aforesaid documents produced by the learned Additional Government Advocate are taken on record.
4. In view of the aforesaid submissions, the writ petition is disposed of with liberty to the petitioner to take recourse to such remedy as may be available to her under the law.
