Heard learned counsel for the applicant and learned AGA for the State.
By way of the instant application, the applicant has prayed for a direction to the court below to decide case no.31 of 2017, under Section 12 of The Protection of Women From Domestic Violence Act, 2005, P.S. Bahariya, District Allahabad, pending in the court of Judicial Magistrate, court no.2 Allahabad expeditiously.
I have considered the submissions advanced by learned counsel for the applicant and perused the record.
Obviously, the court below is under obligation to expedite the proceeding adhering to the provision of Section 309 Cr.P.C. Therefore, no order need be passed by this Court.
Consequently, this application is disposed of.
