Heard learned counsel for the applicant and learned A.G.A. for the State.
The applicant has approached before this Court praying for directing the court concerned to decide the case No. 148of 2018(Smt. Vandana Devi & another Vs. Rajesh) under section 128 Cr.P.C. P.S. Kotwali District Maharajgnaj pending before the Court of Principal Judge, Family Court, Maharajganj within stipulated period.
The argument is that proceeding under section 128 Cr.P.C. is pending since 10.4.2018 before the Principal Judge, Family Court, Maharajganj in case no. 148 of 2018(Smt. Vandana Devi & another Vs. Rajesh) under section 128 Cr.P.C.
Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court concerned to decide the aforesaid case within a period of three months, after providing opportunity of hearing to the other side from the date of presentation of the certified copy of the order.
