JUDGMENT / ORDER

The petitioner was before this Court challenging the recovery proceedings initiated against her. This Court had granted stay for a period of one month by order dated 27.05.2014 on condition of deposit of an amount of Rs.1,00,000/- within ten days. Admittedly the petitioner deposited only Rs.40,000/-. The petitioner sought for an extension which was granted by order dated 25.06.2014 by which two weeks' time was granted to deposit the balance Rs.60,000/-. That order also was not complied with. 2. If an amount of Rs.60,000/-, directed as per the interim order dated 25.06.2014, is deposited within a period of two weeks from today, the petitioner shall be granted six monthly instalments to clear off the entire loan amounts. The petitioner shall produce a certified copy of WP(C).13390/14 2 this judgment before the respondent Bank within two weeks of its receipt. The respondent-Bank shall quantify the dues as on 30.12.2014 and issue a statement of accounts, in accordance with which the instalments shall be paid. The 1st instalment shall be paid on or before 17.01.2015 and thereafter; the due date of instalments falling on the 17th of each succeeding month. If default is committed in two consecutive instalments, then the recovery proceedings shall be revived and continued. On the satisfaction of the dues as per the statement, the Bank shall give a statement of the future interest from 30.12.2014 and the same shall be settled as the 7th instalment.
The writ petition stands disposed of, leaving the parties to suffer their respective costs.
