Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in Crime No. 12 of 2014, dated 05-02-2014, on the file of II Town P.S, Kadapa.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri S.A.V. Sai Kumar, Advocate for the Petitioner and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“The petitioner is A8. He seeks for grant of bail. He allegedly committed offences under Section 332, 307 and 379 IPC as well as offences under the Andhra Pradesh Forest Act, Andhra Pradesh Sandalwood and Red Sandalwood Transit Rules and the Prevention of Destruction of Public Property Act. He allegedly accompanied others in illegal smuggling of red sandal wood. Some of the police officials sustained injuries when the accused and his group pelted stones at the police officials. Where the injuries sustained are on account of pelting of stones and there are no other serious injuries, I would consider it appropriate to enlarge the petitioner on bail.
The petitioner belongs to Kadapa District. The parliamentary and assembly elections are scheduled to take place in Kadapa District on 07.05.2014, I therefore consider that it would be appropriate to direct the release of the petitioner after 07.05.2014 only.
Accordingly, this Petition is allowed. The petitioner is enlarged on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to the satisfaction of the learned I Additional Judicial Magistrate of First Class, Kadapa. The bail granted to the petitioner shall come into force on 08.05.2014. The learned I Additional Judicial Magistrate of First Class, Kadapa shall accept the solvencies on or after 08.05.2014 only.”
