Question is regarding grant of permission for quarry lease.
Learned advocate for the petitioner submitted that though earlier resolution was passed granting permission for quarry lease, but subsequently, different stand has been taken by the Gram Panchayat, since objections were raised by the farmers of the locality. Now the matter is pending before the Collector.
That being the fact situation, let the Collector take decision on the issue after issuing notice to the petitioner as well as considering the objections raised by the farmers. The petitioner is free to raise all the contentions before the Collector. The Collector shall take such decision within a period of one month from today. We however, make it clear that we express no opinion regarding the same. The Collector is free to take decision independent of findings rendered by the learned Single Judge.
Appeal as well as Civil Application stands disposed of accordingly.
