Heard Sri Dharmendra Kumar Tripathi, learned counsel for the applicant and learned A.G.A. for the State and perused the record.
It is a case of gang-rape by the applicant and his associate on a 15 years' old girl. As per the provisions of The Criminal Law (Amendment) Act, 2018 and specifically Rule 22 which relates to amendment of Section 438 Cr.P.C. i.e. "(4) Nothing in this section shall apply to any case involving the arrest of any person on accusation of having committed an offence under sub-section (3) of section 376 or section 376AB or section 376DA or section 376DB of the Indian Penal Code", no anticipatory bail can be entertained.
In view of aforesaid, the instant criminal misc. bail application for anticipatory bail is dismissed Order Date :- 21.8.2019 MN/-
