Heard Sri Mani Shanker Pandey, learned counsel for the petitioner and learned Standing Counsel for the State.
The petitioner is a card holder of Village Panchayat Damgadha, District Allahabad. The submission of learned counsel for the petitioner is that due to malpractices in the distribution of essential commodities by the respondent no.4, the fair price shop dealer, the petitioner is being denied his entitlement of rations and other benefits under the National Food Security Act, 2013. The petitioner has submitted a representation in this regard. However, the authorities have not taken any action thereon. The denial of the rights of the petitioner vested by National Food Security Act continues unabated.
In view of the submissions made at the Bar, the matter requires urgent consideration. The respondent no.2, Additional District Magistrate (Civil Supply), Allahabad, is directed to verify the aforesaid complaints and conclude the enquiry expeditiously within a period of one month from the date of receipt of certified copy of this order. The respondent no.2 shall forthwith ensure that all the card holders in the aforesaid village panchayat shall be given their due entitlement under the National Food Security Act, 2013 and also under various beneficial schemes being run by the State Government, for which they are eligible.
With aforesaid observations present writ petition stands disposed of.
