On 29.06.2021, case was put up for today on the request of learned counsel for the applicant.
Today, nobody is appearing for the applicant.
Sri Gambhir Singh, learned AGA for the State submits that applicant has challenged N.B.W. issued on 26.07.2016 arising out of Case No.351 of 2012, under the provisions of Section 25 of the Arms Act at Police Station-Dhampur, District-Bijnor on the ground that applicant was already enlarged on bail by the learned court of CJM, Bijnor vide order dated 09.08.2012 (Annexure-3) and in Para-7, it is mentioned that since, applicant was staying in Delhi, therefore, he could not appear before the court concerned.
However, the fact of the matter is that as Annexure-2, typed copy of the ordersheets have been produced on record. On 26.07.2016, nobody had appeared for the applicant, nor any application seeking condonation of absence was filed.
Applicant has not filed copies of the ordersheets prior to 17.09.2016 from a date starting from 09.08.2012, when he was extended benefit of bail.
In view of such facts, if applicant has any ground for his absence, then he may appear before the Court concerned and move an appropriate application for recall of warrants.
For the present, I do not find any illegality in the impugned order of issuance of N.B.W. against the applicant and, therefore, Application fails and is dismissed.
