1. Rule.
Mr K.L. Pandya learned APP waives service of rule on behalf of the State.
2. The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to take care of cultivation of his land. It appears that the applicant-convict had made the application in the recent past being Criminal Misc. Application No. 17228/2011 and it has been rejected vide order dated 20.12.2011. Again for the same ground, another application has been preferred. Hence, the discretion does not deserve to be exercised, and therefore, the application is not granted. Rule is discharged.
