Heard learned advocate for the parties.
2. Upon assurance given by the applicants that they want to maintain peace and will follow rules and regulations prescribed under Jail Manual and no further act of disobedience will be committed by them and they will stay with other inmates peacefully.
3. Upon issuance of notice, learned APP, on instructions submits that the applicant No.1 is in Gondal Jail and the applicant Nos.2 and 3 can be accommodated subject to the above assurance given by the applicants.
4. Having heard learned advocates for the parties, considering the peculiar facts and circumstances of the case and assurance given by the applicants and more particularly when the trial is to take place in Sessions Case No.39 of 2010 at Rajkot, the respondent authorities shall consider the case of the applicant Nos.2 and 3 to accommodate them in Gondal Jail and pass appropriate order at the earliest.
This petition is allowed to the aforesaid extent only.
