Heard Sri Y.P.Tripathi, learned counsel for the petitioner, Sri Gambhir Singh, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioners with a prayer to direct the respondent nos. 1, 2 & 3 to call the progress report in pursuance of the FIR dated 24.7.2018 according to procedure of Cr.P.C. having Case Crime No.341 of 2018, under Sections 376, 328, 312, 323, 506 I.P.C., P.S. Sarnath, District Varanasi It has been contended by learned counsel for the petitioner that petitioner is the victim/informant of the present case and she has lodged the impugned FIR against the respondent no.4 on 24.7.2018, but nothing has happened, hence, she has come up before this Court with the aforesaid prayer as she apprehends that investigation is not being carried out in a fair and proper manner.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of three months from the date of production of a certified copy of this order.
It is further directed that the S.S.P.,Gorakhpur shall supervise the investigation and ensure that the same is completed speedly without any undue delay.
With the above directions this petition is finally disposed of.
