Challenge made in the present petition by the petitioner is to the order dated 30.08.2011 passed by the Principal District Judge Panchmahal, Godhra in Misc. Civil Appeal No. 31 of 2010. The order of status quo was granted and the same was extended till the final decision of the appeal. Thereafter, the appeal was allowed partly on 30th August 2010. Aggrieved by the same, this petition is preferred under Article 227 of the Constitution of India. In favour of the petitioner ad interim relief has been granted on 14.09.2011 and the same continues till date. The relief in terms of status quo is regarding the possession.
Further, without dilating the facts, it would be desirable to continue the order of status quo granted by this Court on 14th September 2011 till the final disposal of the Regular Civil Suit no. 7 of 2010 while relegating the parties to the trial court to abide by the order of the lower appellate court in expeditiously proceedings with the trial of the Regular Civil Suit No. 7 of 2010 . Trial court shall, as far as possible, dispose of the suit within six months from the date of this order by following the provisions of law.
Writ petition stands disposed of in the above terms.
