1. Heard Mr. Ketan Shah, learned advocate for the petitioner and Mr. Janak Raval, learned AGP for the respondents.
2. Under order dated 2.6.2011, office was directed to issue Notice making it returnable on 17.6.2011. Since then, though almost one year has passed, the respondents have not filed any reply-affidavit and the proceedings are being adjourned for want of reply from the respondents. For the delay which has already been caused, appropriate order imposing cost for not filing reply-affidavit for almost one year, will be passed hereafter.
3. However, for the present, time is granted until 5.7.2012 to the respondents to file reply-affidavit.
4. If reply-affidavit is not filed before the next date, the Court may pass appropriate order in the petition including order imposing exorbitant cost which shall have to be paid personally by the person responsible to make the affidavit. Such order imposing costs will be independent and in addition to the order which the Court proposes to pass for the delay of one year which has been caused in further hearing of the present petition for want of reply by the respondents.
5. If any interim relief is in operation, the same will continue.
