JUDGMENT / ORDER

The grievances of the petitioners are basically about inaction on part of the respondents of not registering the First Information Report pertaining to the complaint, but at the same time, Circle Police Inspector, Karjan Circle as early as on 03.11.2011 has requested the learned Judicial Magistrate First Class (JMFC), Karjan to order further investigation under Section 173(8) of Criminal Procedure Code, 1973 (the Code) but as per the information, no decision is taken by the learned JMFC on the basis of request of the investigating officer.
It will be open for the petitioner to take appropriate action in accordance with law but at the same time, the learned JMFC, Karjan is duty bound to exercise his powers with regard to the above application of the investigating agency under Section 173(8) of the Code in accordance with law.
With the aforesaid, this petition stands disposed of. Direct Service is permitted.
