THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.15189 of 2014 Dated : 04.06.2014 Between:
Vadde Venkateswara Reddy, S/o V.Pedda Papi Reddy, 52 yrs., R/o Plot No.102, Ayyappa Residency, Near A.V.Subba Reddy’s house, N.G.O’s colony, Nandyal Town, Kurnool District and another .. Petitioners And The State of Andhra Pradesh, Rep. by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and four others .. Respondents This Court made the following :
THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.15189 of 2014 ORDER :
The petitioners claim to be the owners of the land to an extent of Ac.0.88 cents in Survey No.192/1 situated in Moolasagaram Village, Nandyal Mandal, Kurnool District and also claim that they are the vendors of the said land and succeeded the same before this Court in establishing the title as well as the award passed in A.S.No.22 of 1986 on 23.09.1986. However, when the petitioners approached the 5th respondent for market value certificate, the 5th respondent gave an endorsement dated 30.05.2014 informing the petitioners that the said land is included in the list of prohibited properties. Aggrieved thereby, the petitioners submitted a representation to the District Collector on 15.04.2014 informing them that due to mistake and oversight, wrongly the property is included in the list of prohibited properties. In the said representation, the earlier orders of this Court as well as the award dated 23.09.1986 were also brought to the notice of the District Collector.
2. Learned counsel for the petitioners submits that such representation is not disposed of till date and a direction may be issued to the District Collector to dispose of the said representation.
3. Having regard to the aforesaid submissions, without expressing any opinion on merits, this Writ Petition is disposed of directing the 2nd respondent to consider the representation of the petitioner dated 15.04.2014 and pass appropriate orders as warranted by law and communicate the decision to the petitioners within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
