HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26737 of 2009 ORDER:
Though counsel for the petitioners is absent, on hearing the learned Assistant Government Pleader, this Court feels that this writ petition need not be kept pending for the presence of the learned counsel for the petitioners.
2. The petitioners are the fair price shop dealers of various villages in Unguturu Mandal of Krishna district. They filed the present writ petition challenging the inaction of the 3rd respondent in releasing kerosene quota in spite of circular dated 12.01.2009. Though the circular orders were issued in their favour, contrary to it, in respect of Unguturu Mandal, the kerosene quota of the deceased hawker is being allotted to another hawker (as in-charge). On the representation of the Welfare Association of the petitioners, 2nd respondent issued circular on 12.01.2009 instructing the Tahsildar concerned to rectify the defects in allowing kerosene quota and in turn the 3rd respondent has issued an order 02.02.2009 allotting the kerosene quota to the petitioners for the month of February 2009, but the same was not implemented. In those circumstances, the present writ petition was filed.

Learned Assistant Government Pleader on the basis of the instructions issued by the 2nd respondent on 15.02.2010, submits that the allotment of kerosene is being given to the Tahsildar, Unguturu Mandal and the Tahsildar issued orders allotting kerosene to the villages, which were indicated in the licence at the time of issue of Form-B Licence only but not in place of deceased hawker. It appears on the demise of the hawker, allotment was being made to the fair price shop dealers for distribution of the kerosene to the cardholders under Public Distribution System as per the instructions of the Government. After issuing instructions dated 12.01.2009, no allotment of kerosene has been made to the hawkers or by making in-charge arrangement.
4. In view of the statement made by the learned Assistant Government Pleader on the basis of the instructions received by him, nothing survives for adjudication in the present writ petition.
5. Recording the said statement of the learned Assistant Government Pleader, the writ petition is closed. Pending miscellaneous petitions in this writ petition, if any, shall stand closed. No order as to costs.
