THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No.1666 of 2014 Judgment: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) Sri K.S. Murthy, learned counsel, fairly submits that the Hon’ble trial Judge was not assisted properly by any of the parties to the proceedings. He therefore submits that the impugned order may not be sustained.
Accordingly, we set aside this order. However, this order will not prevent and prejudice any of the parties from filing miscellaneous application with the fresh materials not relied on earlier by the parties.
The writ appeal is accordingly allowed.
Consequently, pending miscellaneous petitions, if any, shall also stand closed. No costs.
