Heard Sri P.Venkateshwer Rao, learned counsel appearing for the petitioner and Sri N.Vasudeva Reddy, learned Standing Counsel for the respondents-Andhra Pradesh State Road Transport Corporation (the Corporation, for short).

This writ petition is filed to declare the action of the respondents in not allowing the 20 years Special Grade/Stagnation Increment to the petitioner as bad, arbitrary and illegal, and contrary to the judgments of this Court by setting aside proceedings dated 13-10-2014 of the 2nd respondent herein and consequently direct the respondents to effect the 20 years Special Grade/ Stagnation increment to the petitioner with effect from the completion of 20 years of service from his initial appointment by counting the period which he was kept out of employment from the date of suspension relating to removal to the date of reinstatement (i.e. from 28-6-2001 to 04-02-2006) by paying arrears for which he is entitled.

While setting aside the removal order dated 29-12-2001 passed by the 3rd respondent herein, by an award dated 26-9-2005 in I.D.No.5 of 2005, the Industrial Tribunal-II, Hyderabad granted continuity of service and all other attendant notional benefits to the petitioner without back wages. Therefore, obviously he is entitled for 20 years stagnation increment as held by learned single Judge of this Court in W.P.No.24965 of 2007 in relation to a case involving identical issue.

The present writ petition is, therefore, disposed of in terms of the order dated 19-3-2008 in W.P.No.24965 of 2007 passed by the learned single Judge of this Court, directing the respondents-Corporation to release 20 years stagnation increment to the petitioner but not counting the service from the date of removal till the date of reinstatement. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
