This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to direct the respondent to pay the insured amount as per the insurance policy bearing No.2013162 to the petitioner immediately and for with by considering representations dtd. 05.06.2010, 07.12.2011 and 07.04.2017 at Annx-F and J and etc.
This Petition coming on for Preliminary Hearing in ‘B’ group this day, the Court made the following:-
ORDER Sri.S.H.Raghavendra, learned counsel for the petitioner.
Sri.Y.D.Harsha, learned Additional Government Advocate for the respondent.
2. The petition is admitted for hearing. With consent of the learned counsel for the parties, the same is heard finally.
3. In this petition, the petitioner inter alia has prayed for the following reliefs:
i. Issue writ of mandamus or order or other appropriate direction directing the respondent to pay the insured amount as per the insurance police bearing No.2013162 to the petitioner immediately and for with by considering representations dated 05.06.2010, 07.12.2011 and 07.04.2017 at Annexure-F, G and J.
ii. For such other relief or relief as this Hon’ble Court may deem fit to grant under the facts and circumstances of the case, in the interest of justice and equity.”
3. When the matter was taken up today, learned counsel for the petitioner submitted that the petition be disposed of with a direction to the competent authority to consider and decide the representations submitted by the petitioner dated 05.06.2010, 07.12.2011 and 07.04.2017 contained in Annexures-F, G and J. On the other hand, learned Additional Government Advocate submits that suitable action in accordance with law shall be taken on the aforesaid representations.
4. In view of the aforesaid submissions and in the facts of the case, the petition is disposed of with a direction to the competent authority to consider the aforesaid representations in accordance with law within two weeks from the date of receipt of certified copy of the order passed today, by a speaking order.
