Heard the learned counsel for the petitioner and the learned Government Pleader for Social Welfare.
The petitioner’s grievance is that the Inspector of Wakfs, the 3rd respondent herein, is physically interfering with the petitioner’s possession over house site admeasuring 244.44 square yards in Sy.No.590 of Kallur Village and Mandal, Kurnool District.
While issuing notice before admission on 29.04.2014, liberty was given to the 2nd respondent to take appropriate action under Section 52 of the Wakf Act, 1955 or otherwise thereof, but the 3rd respondent shall not physically interfere with the petitioner’s possession without issuing notice to him.
The learned Standing Counsel for the Wakf Board, on instructions, submits that the 3rd respondent is not interfering with the petitioner’s possession, as alleged, and if any action is required to be taken, appropriate procedure under the Wakf Act be followed.
In view of the said statement on behalf of the respondents that they would take appropriate steps, if so required, in accordance with the Wakf Act, the petitioner’s grievance appears to be only based on apprehension and as such no further act is warranted in this writ petition.
The writ petition is accordingly disposed of. There shall be no order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
