ORDER:
The grievance of the petitioner-society in this writ petition is that despite letter addressed by respondent No.3 to respondent No.2 for making arrangements for conducting elections to its Managing Committee, no steps are being taken by respondent No.2.
A perusal of the record shows that vide his letter in Rc.No.2061/2010-H, dated 11.08.2014, respondent No.3 has informed respondent No.2 that the term of the Managing Committee of the petitioner-society was going to expire by 23.10.2014. He has, therefore, requested respondent No.2 to make arrangements for conducting elections.
The case was adjourned on 15.10.2014 to enable the learned Assistant Government Pleader for Cooperation (TS) to obtain instructions. Today, the learned Assistant Government Pleader reported no instructions.
Under Section 31(2)(b) of the A.P.Cooperative Societies Act, 1964 it is the duty of the Registrar to hold elections to the office of the members of the committee of a society which receives State aid before expiry of its term. The fact that respondent No.3 has addressed letter to respondent No.2 shows that the petitioner is receiving State aid. Failure of respondent Nos.2 and 3 in holding elections before expiry of the term of the previous Managing Committee is in violation of the above-mentioned statutory provision.
Respondent No.2 is therefore directed to forthwith initiate steps for holding of elections to the Managing Committee of the petitioner- society and ensure that the process of election is completed within two months from the date of receipt of a copy of this order.
Subject to the above directions, the writ petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.38507 of 2014 shall stand disposed of as infructuous.
