Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
In this writ petition, the petitioner questions inaction on the part of respondent No.3-Revenue Divisional Officer, Jammalamadugu, in completing enquiry and passing final orders with respect to issuance of pattadar passbooks and title deeds to him in respect of the land to an extent of Ac.21.58 cents in Sy.No.536 of Gundlamadugu Village, Thonduru Mandal, YSR District. The petitioner states that on his application, an enquiry was proposed to be held by respondent No.3 and as per endorsement in Ref.No.A/284/2007, dated 01.02.2013, respondent No.4 – Tahsildar has taken steps in conducting enquiry, but the same has not been finalized in spite of lapse of substantial time.
Learned Government Pleader, who has taken time to get instructions, received instructions that as against the petitioner’s claim, there is a rival claim by third parties and that notices have already been issued by respondent No.3, pursuant to which the petitioner and the said rival claimants have appeared and that the said enquiry was adjourned to enable the parties to file appropriate documents. However, the enquiry could not be completed and orders could not be passed on account of respondent No.3 being presently occupied by the Election process and as soon as the Election process is over, he will take appropriate steps.
In the circumstances, the writ petition is disposed of directing respondent No.3 to issue notice to all the parties, conduct appropriate enquiry and pass appropriate orders in accordance with law, preferably within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
