Respondents Criminal Original Petition filed under Section 482 Cr.P.C. to issue a direction to the respondent No.1, to decide the representation of the petitioner dated 4.12.2016 in accordance with law, and further to direct the respondents 2 and 3 not to harass the petitioner and his employees.
For Petitioner : Mr.P.Pugalenthi For Respondents : Mr.C.Emalias Addl.Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the first respondent to decide the representation of the petitioner dated 4.12.2016 in accordance with law, and further to direct the respondents 2 and 3 not to harass the petitioner and his employees.
2. It is the case of the petitioner that after his retirement from military, he has been running a plywood shop in the name and style of Sri Jeya Plywood at Namakkal Town and he has a rental agreement with the owner of the said property. Since the owner of the said shop is trying to vacate the petitioner with the help of some rowdy elements, he filed a suit in O.S.No.317 of 2007 before the District Munsif Court, Namakkal, seeking permanent injunction and obtained permanent injunction in his favour. However, the respondents 2 and 3, colluding with the owner of the property, threatened the petitioner to vacate the shop. In this regard, the petitioner made a representation dated 4.12.2016 to the respondents requesting them not to harass him. Since the same was not considered so far, the petitioner has come up with the present petition.
3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.
4. In view of the limited prayer sought for by the petitioner, without going into the merits of the case, the first respondent is directed to consider the representation of the petitioner dated 4.12.2016 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order, after affording an opportunity of personal hearing to the petitioner as well as to the necessary parties.
