This writ petition is filed for declaring the action of the 3rd respondent in withholding/collecting seigniorage fee from the final bill in respect of Agreement dated 15-07-2011 as illegal, arbitrary and contrary to the terms of the agreement and for a consequential direction to the respondents not to collect seigniorage charges from the final bill in respect of the agreement dated 15-07-2011.
2. When the matter is taken up for hearing, learned counsel for the petitioner as well as the learned standing counsel for the respondents represented that the subject matter of the present writ petition is squarely covered by a common judgment of this Court dated 20-09-2013 in W.P.No.18125 of 2012 and batch and the present writ petition is identical to that of batch of writ petitions.
3. Recording the said submission and for the reasons alike, the writ petition is allowed declaring the action of the respondent-
Corporation in seeking to collect seigniorage charges for refilling of earth undertaken by the petitioner concern in the course of the subject civil works to be illegal. No costs. As a sequel thereto, miscellaneous petitions if any pending shall stand closed.
Let a copy of the order in W.P.No.18125 of 2012 and batch dated 20-09-2013 be annexed to this writ petition.
