Madras High Court|23 February, 2017

JUDGMENT / ORDER

By consent, the main writ petition itself is taken up for final disposal.
2. Mr.K. Dhananjayan, learned Special Government Pleader accepts notice on behalf of the respondents.
3. The petitioners, in the affidavit filed in support of the writ petition, would aver, among other things, that they are presently serving as Deputy Collectors in the Revenue Department, Government of Tamil Nadu and are working at various places. According to them, they became eligible for promotion to the post of District Revenue Officer in the year 2015 as they possess the requisite qualification and experience in accordance with the Tamil Nadu Service Rules. The grievance of the petitioners is that though proposals were sent by the respectice Collectors and the panel of Deputy Collectors fit for promotion to the post of District Revenue Officer was also drawn and approved by the Government and ultimately, G.O.Ms. NO. 226 Public (Special A) Department dated 29.02.2016 was issued, the petitioners, who have been enlisted in the panel, have not yet been promoted to the post of District Revenue Officer, in spite of availability of vacancies. In this regard, their association as well as the petitioners submitted representations dated 10.01.2017, 08.02.2017 and 15.02.2017 respectively and no action having been taken, they are constrained to approach this Court by way of this writ petition.
4. Mr.S. Vijayakumar, learned counsel for the petitioners would submit that most of the petitioners are aged between 54 and 56 years and in the light of the preparation of panel for promotion to the post of District Revenue Officer and issuance of G.O.Ms. No. 226 Public (Special A) Department dated 29.02.2016 and all the petitioners, having been possessed with requisite qualification, there cannot be any impediment on the part of the respondents to promote the petitioners to the post of District Revenue Officer and prays for appropriate orders.
5. This Court heard the submissions of Mr.K. Dhananjayan, learned Special Government Pleader for the respondents.
