THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No. 913 of 2014 JUDGMENT: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) This appeal is sought to be admitted against the impugned judgment and order dated 23.03.2011 by which the learned Trial Judge was pleased to dismissed the writ petition.
It appears that His Lordship has taken pain of going through each and every aspect of the matter and found that the orders of the authority are based on documents and no interference is called for.
We should not substitute our own appreciation of fact and we accept the finding of the learned Trial Judge. However, to clarify the judgment and order of the learned Trial Judge, it will not prevent the appellant from initiating any legal action with regard to the genuineness of the registered sale deed dated 17.12.1964, if so permissible under law.
The appeal is accordingly dismissed. No order as to costs.
Miscellaneous petitions, if any, pending in this appeal shall stand dismissed.
