ORDER:
This writ petition is filed with the grievance that respondent Nos.2 and 3 have not been allotting essential commodities to the petitioner for distribution through fair price shop bearing No.2 of Panchali Nagar, Renigunta Town and Mandal, Chittoor District, from the month of October, 2014.
At the hearing, the learned Assistant Government Pleader for Civil Supplies, on instructions, submitted that as the petitioner failed to submit the demand draft towards the value of the essential commodities in time, the allotment was not made.
This submission is strongly denied by the learned counsel for the petitioner.
Ordinarily, a dealer of a fair price shop is not expected to delay submission of the demand draft and approach this Court for a direction to supply essential commodities. Therefore, the stand of the respondents as reflected in the submission of the learned Assistant Government Pleader is somewhat difficult to believe. Be that as it may, the petitioner is permitted to submit the demand draft within the permissible time from the month of November, 2014. On such submission, respondent Nos.2 and 3 shall allot essential commodities for distribution in pursuance of the petitioner’s authorisation.
Subject to the above directions, the writ petition is allowed.
As a sequel to disposal of the writ petition, W.P.M.P.No.38319 of 2014 shall stand disposed of as infructuous.
