HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3881 of 2010 ORDER:
The petitioner was appointed as fair price shop dealer of Chirrajupalli village and he has been running the same for the last 32 years. While so, in the last week of November, 2009, the 2nd respondent conducted an enquiry on the ground that he received complaints from 10 persons of the village stating that he has not distributed the essential commodities for the month of October, 2009. The enquiry team verified the records and noted stock position. While so on 17.02.2010, the petitioner received impugned order, dated 05.12.2009 suspending the authorisation of the petitioner, pending enquiry.
2. This Court by order dated 19.02.2010 while granting interim suspension of the said order, gave liberty to the respondents to conduct enquiry in accordance with law. Learned Assistant Government Pleader for the respondents is unable to say whether the enquiry was completed or not.
3. In the circumstances, the 1st respondent is directed to complete the enquiry against the petitioner pursuant to the report of the 2nd respondent dated 21.11.2009 within a period of three months from the date of receipt of a copy of this order, if it was not already completed.
4. With the above direction, the writ petition is disposed of. Pending miscellaneous petitions in this writ petition, if any, shall stand dismissed in consequence. No order as to costs.
