JUDGMENT / ORDER

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the concerned records from the respondents and to quash the order of the second respondent bearing Memo No.006169/Adm/A1/F.Assr./2003 dated 01.09.2003 and the order of the first respondent bearing proceeding No.004624/1164/ SP/Ar/U.1/2004-1 dated 14.07.2004 and to consequently direct the respondents to give all the increment due to the petitioner.
2. Heard the arguments advanced on either side and perused the materials available on record.
3. The petitioner challenges the order of the second respondent dated 01.09.2003, wherein, the petitioner was directed to pass the second class language test in Tamil conducted by the T.N.P.S.C. as per the Regulation 91(3)(a)(i) of Tamil Nadu Electricity Board Service Regulations.
4. After filing this writ petition, the petitioner acquired the requisite qualification and the same was sent to verification of its genuineness. It is useful to extract hereunder paragraph no.7 of the counter affidavit:
“7.In the meanwhile the Secretary Tamil Nadu Secondary Education, Chennai in his letter dated 7.2.2005 informed the 2nd respondent that the certificate of the petitioner received for verification is genuine. Thereafter, the Respondent in his Memo. Dated 2.3.2005 ordered that the petitioner had satisfactorily completed the period of probation on 27.8.2000. Pursuant thereof, the 2nd Respondent in his Memo. Dated 8.3.2005 sanctioned increments to the Petitioner and permitted the Petitioner to draw the arrears of pay and allowances with effect from 28.08.2000. In view of the subsequent developments and orders passed by the Respondents granting relief to the Petitioner, the above W.P. has become infractions as he had received all the benefits prayed for in the above W.P.”

5. In view of the above, nothing survives in this writ petition for adjudication and the same is closed. No costs. Consequently, the connected miscellaneous petition is also closed.
