JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 15.06.2017 CORAM:
THE HONOURABLE MR.JUSTICE K.K.SASIDHARAN and THE HONOURABLE MR.JUSTICE M.V. MURALIDARAN
W.P. No. 4281 of 2017
V.Kannayiraman ...Petitioner Vs
1. The District Collector Villupuram 605 602.
2. The Revenue Divisional Officer Thirukovillur, Villupuram 605 757.
3. The Thasildar Ulundurpet, Villupuram 606 117. ...Respondents Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Certiorarified mandamus calling for the records in proceedings O.Mu.A2/3781/2016, dated 11.08.2016 on the file of 2nd respondent and quash the same as illegal, incompetent and wholly without jurisdiction and further direct the 2nd respondent to issue a community certificate to the petitioner as "Hindu-Malaikuravan".
For Petitioner : Mr.M.Muruganathan for Ms.Sripriya For Respondents : Mr.K.Dhananjayan, Special Government Pleader
O R D E R
K.K.SASIDHARAN,J.
The petitioner lost his original card relating to the community status and the other details given by the Revenue Divisional Officer. The petitioner submitted application for issuance of a fresh certificate. The Revenue Divisional Officer issued a duplicate copy of the certificate, making it clear that there is no provision to issue another original. The order is under challenge in this writ petition.
2. The learned counsel for the petitioner contended that it is not possible for the petitioner to avail the benefits on account of the possession of only a duplicate certificate, instead of a certificate in original. According to the learned counsel, the second respondent was not correct in rejecting the request made for issuing a fresh certificate.
3. We have also heard the learned Special Government Pleader on behalf of the respondents.
4. The documents available on record indicate that the second respondent issued Certificate Nos.2645018 and 2645019 in the prescribed format to the petitioner on 02 August 1991 indicating the caste status. The petitioner approached the second respondent for another copy after preferring a police complaint that he lost the original card. The second respondent therefore, issued a duplicate copy. The second respondent has also made it clear that it would not be possible to issue a fresh card. It is open to the petitioner to use the duplicate certificate issued by the second respondent for all purposes, as it was issued by the competent authority , in the place of the original which was lost.
The writ petition is disposed of with the above observation. No costs.
